Terms of Use

These terms are an agreement between you and Loft Golf ("Loft Golf", "we", "us") for the Loft Golf mobile game, the browser demo and loftgolfgame.com (the "Service"). By downloading, installing or playing, you agree to them. If you don't agree, please don't use the Service. Our privacy policy explains how we handle your information.

1. Who can play

You must be at least 13 years old, or the minimum age in your country, to use the Service. If you are under 18, you need a parent or guardian's permission, especially before making purchases.

2. Your account

The game creates an account for your device when you play online. You choose a display name. It must not be offensive, misleading or someone else's name or trademark, and we may change or remove names that break these rules. You are responsible for activity on your account and for keeping your device secure.

3. Licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to download and play Loft Golf for your own non-commercial entertainment. You may not copy, sell, rent, modify, reverse engineer or redistribute the game, or use it to build a competing product, except where the law allows. All game content, art, names and code belong to Loft Golf or its licensors.

4. Virtual items and currency

• The game includes virtual items, such as golf balls, clubs, cosmetic looks, tiers and in-game currency, that you can earn or buy.
• Virtual items are a limited licence to use content inside the game. They are not real property, have no cash value, and can't be sold, traded or exchanged for money or anything outside the game.
• Except where the law or the store's own policy requires otherwise, purchases are final and non-refundable once delivered. Refunds are requested from the App Store or Google Play. If a store refunds a purchase, we remove the items it granted.
• We may change, rebalance or retire items and prices to keep the game fair and fun. Items you bought are not taken away without reason, except as described in these terms.

5. Purchases and subscriptions

Payments are processed by Apple or Google under their terms. Subscriptions renew automatically until cancelled. You can cancel at any time in your store account settings, at least 24 hours before the current period ends to avoid the next charge. Prices are shown in the store before you buy and may include taxes.

6. Fair play

You agree not to:

• cheat, use bots, scripts, modified clients or exploits, or tamper with shots, scores or the server;
• create multiple accounts to manipulate leaderboards, tournaments or rewards;
• harass, threaten or impersonate other players, or use hateful or sexual names;
• buy, sell or trade accounts or items outside the game;
• attack, overload or try to gain unauthorised access to the Service.

Every public score is replayed and checked on our server. We may remove results, reset progress, or suspend or close accounts that break these rules, without refund where the law allows.

7. Competitions, tournaments and sponsors

Daily challenges, tournaments and leaderboards are skill-based games for in-game rewards only. No purchase is required to enter, and there are no cash prizes unless an event's own rules clearly say otherwise. Sponsored content and rewards are provided by the sponsor or by us, and are subject to any terms shown with them.

8. Changes and availability

We are always improving Loft Golf. We may update, change or stop parts of the Service, and some features need an internet connection. We will try to give notice before shutting down the online service. We are not liable for interruptions, lost connections or data loss beyond what the law requires.

9. Ending your account

You can stop playing and delete your account at any time from the game's settings. We may suspend or end your access if you break these terms or if we have to by law. When an account ends, its virtual items are lost.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms limits rights you have under consumer laws that can't be excluded.

11. Limit of liability

To the fullest extent the law allows, Loft Golf is not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or US$50 if greater. Some places don't allow these limits, so they may not apply to you.

12. Apple and Google

These terms are between you and Loft Golf, not Apple or Google, and we, not they, are responsible for the game and support. If you got the game from the App Store, Apple's Standard Licensed Application End User License Agreement also applies, and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Apple has no obligation to provide maintenance or support for the game.

13. Changes to these terms

We may update these terms. We will change the date at the top and, for important changes, tell you in the game before they take effect. Continuing to play after that means you accept the new terms.

14. General

These terms are governed by the laws of the United States and the state where Loft Golf is based, without regard to conflict-of-law rules, except where your local consumer law says otherwise. If part of these terms can't be enforced, the rest still applies. Not enforcing a term is not a waiver of it.
